Software and Data License Terms – Screen & Mobile

Please read these Software and Data License Terms carefully before downloading or using Don Best Sports Software.
DonBest Sports Software, including DBS4, the DBS Mobile application, and any OpenBet-created proprietary programs and operating information (“Software”), is made available to customers by DonBest Sports (“OpenBet”), a Nevada corporation and subsidiary of Endeavor.

Acceptance

By clicking “ACCEPT”, or by using the DonBest Sports Software, User agrees to be bound by these Terms. If User does not agree to all Terms, please click “DO NOT ACCEPT” and delete the application from your device.
User’s agreement to these Terms includes User’s agreement to arbitrate any claims arising from these Terms or use of the Software or Data pursuant to the Federal Arbitration Act (“Agreement to Arbitrate”).

Single Limited License Grant

OpenBet grants the User a non-exclusive, non-transferable, revocable limited license (“License”) to:

  • View the licensed materials, rotation IDs, schedules, injury reports, research reports, line-ups, statistics, betting lines and/or wagering odds or other data (“Data”) provided by OpenBet, and
  • Use the Software in object‐code form to view the Data solely on a single central processing unit owned by User.

This License is the entire License between the parties with respect to the use of the Data and Software.

User Shall Not:
  • Copy any Data or Software
  • Modify any Software
  • Steal or scrape Data from the Software
  • Reverse compile or reverse assemble any Software
  • Rent, lease, distribute, sell, or create derivative works of any Software
  • Violate these Terms

This License is effective until terminated. User may terminate this License by:

  • Not paying OpenBet for use of the Software/Data, or
  • Providing OpenBet with 5 days’ prior notice and deleting all copies of Software (including any Data).

OpenBet may terminate immediately without notice if User violates any provision. Upon termination, User must delete all Data and Software.
Software, including technical data, is subject to U.S. export control laws. User agrees to comply strictly and obtain any required export/import licenses.

Software Changes & Termination

At its sole discretion, with or without notice, OpenBet may:

  • Update or discontinue the Software or any part thereof
  • Change the content of the Software or Data
  • Restrict use or access to the Software or Data

OpenBet will have no liability if the Software or Data is discontinued or access terminated.

Data Collection

User agrees that OpenBet and its third-party vendors may collect technical and usage data (device info, geolocation, access time, etc.) to facilitate updates, support, and targeted advertising. User consents to receive push notifications.

Confidential Information

The Data and the specific design and structure of the Software constitute confidential information and trade secrets. User shall not disclose or share this information and shall use reasonable security measures to protect it.

Regulatory Compliance

User will maintain all necessary licenses, permits, and approvals, comply with all applicable laws (anti-corruption, AML, gaming regulations), and pay applicable taxes.
If requested by Endeavor, User shall provide compliance information (financial, background, etc.). Failure or disapproval by a gaming authority may result in termination.
User represents that they have not:

  • Been convicted of a felony or gambling-related offense
  • Had a gaming license denied, suspended, or revoked
  • Offered improper inducements to anyone at OpenBet
No Warranty

THE SOFTWARE AND DATA IS PROVIDED “AS IS,” WITHOUT WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NONINFRINGEMENT, OR ARISING FROM USAGE. USER’S USE IS AT USER’S SOLE RISK.

Liability Limit

OpenBet’s entire liability under any theory shall not exceed the price paid by User. OpenBet is not liable for lost revenue, profit, data, or for special, indirect, or consequential damages.

Agreement to Arbitrate & Class Action Waiver

Any claim must be settled by arbitration under AAA Commercial Rules in Las Vegas, Nevada, before a single arbitrator. Claims must be filed individually; class actions are waived.

Governing Law & Venue

These Terms are governed by the laws of Nevada, USA. Any claim must be filed within one (1) year after it arose or be forever barred.
